These Terms of Service ("Terms") govern your use of the website at www.lemmingtons.com (the "Site") operated by  ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Site or purchase products.

1. Terms of Sale and Ordering

1.1 Contract Formation

All products offered on the Site are an invitation to treat and not a binding offer to sell. Your submitted order constitutes an offer to purchase the products. We must accept this offer, which is confirmed by sending you an Order Confirmation Email. A legally binding contract is formed only when you receive this email.

 

1.2 Product Availability and Pricing

All product prices are listed in GBP and are subject to change without notice. We make every effort to display accurate product availability, pricing, and descriptions. In the event of an error, we reserve the right to correct the price, adjust the order, or cancel the order and issue a full refund.

 

1.3 Order Cancellation and Changes

Because our products are baked-to-order, changes or cancellations must be requested within a specific time frame:

  • Standard Items: Items ordered between 12:00 Mondays and 23:59 Saturdays will be baked on the following Monday for collection/delivery/dispatch on Tuesday.

  • Custom Orders (Cakes, Catering): Contact us directly 

 

1.4 Pickup and Delivery

You are responsible for providing an accurate delivery address and ensuring someone is available to receive the order or during the agreed-upon window.

  • Pickup: We are not responsible for orders that are not picked up by the agreed-upon time. Uncollected items may be disposed of for food safety reasons, and no refund will be issued.

  • Delivery: Once the product has been delivered to the confirmed address, we are not liable for any damage, loss, or theft.

 

2. Allergy and Dietary Disclaimer

 

2.1 Gluten-Free Guarantee

We certify that all products are  gluten-free are made with ingredients that do not contain gluten or have any may contain statements . We adhere to strict protocols to prevent any contamination to the best of our ability. Ie No gluten in store whatsoever.

 

2.2 Other Allergens and Cross-Contamination

Lemmingtons uses common food allergens in our facility, including but not limited to: dairy, eggs, nuts (tree and ground), soy, and sesame.

While we take all reasonable precautions to minimize the risk of cross-contact, we do not guarantee that any of our products are completely free of these other allergens. By purchasing from us, you acknowledge that you are responsible for informing yourself and your guests of these risks. We are not liable for any adverse reactions to food products consumed.

 

3. Intellectual Property

 

The Site and all of its original content, features, and functionality (including images, text, logos, and product designs) are owned by Lemmingtons and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or use any content from this Site without our express written permission.

 

4. Acceptable Website Use

You agree not to use the Site to:

  • Transmit any unauthorized advertising, promotional materials, or spam.

  • Misuse the Site by introducing viruses, Trojan horses, or other malicious or technologically harmful material.

  • Attempt to gain unauthorized access to the Site, its servers, or any related computer systems.

  • Interfere with the security or operation of the Site.

We reserve the right to terminate your use of the Site for violating any of these prohibited uses.

 

5. Limitation of Liability and Disclaimer

The Site and its products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Lemmingtons disclaims all warranties. We are not liable for any indirect, incidental, or consequential damages resulting from your use of, or inability to use, the Site or the products purchased, except where such exclusion is prohibited by law.

Your sole and exclusive remedy for any product defect or dissatisfaction is the remedy outlined in our separate Return and Refund Policy.

 

6. Governing Law

These Terms shall be governed by the laws of the Untited Kingdom Of Great Britian without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the products purchased shall be subject to the exclusive jurisdiction of the courts located in Merseyside.
